Michael J. Tier, Esq. is an intellectual property attorney with extensive experience in all aspects of trademark and copyright law and a practice focused on trademark procurement, clearance counseling, worldwide trademark portfolio management, counseling, enforcement, and Trademark Trial and Appeal Board proceedings. He has represented clients across a wide range of industries, including biosciences, pharmaceuticals, health care, medical devices, consumer goods, retail, and hospitality, and advises clients on copyright protection and enforcement, brand-development strategies, and agreements involving intellectual property rights.

Michael began his career as a trademark paralegal working for both large law firms and major corporations. Michael then attended Widener University School of Law.

Throughout his career, Michael has been an active member of the Philadelphia Bar Association, the Benjamin Franklin American Inn of Court, and Philadelphia Volunteer Lawyers for the Arts.  Outside of work, Michael enjoys creating music, reading, and spending time with his wife, son, and many pets.

REPRESENTATIVE EXPERIENCE
  1. Managed an international trademark portfolio comprising more than 5,000 active marks for an international manufacturing company.
  2. Enforced a national cleaning-products manufacturer’s trademark rights across numerous jurisdictions worldwide.
  3. Represented a national manufacturer of cleaning products throughout trademark litigation, playing a substantial role in case strategy, discovery, motion practice, and the negotiations that resulted in settlement.
  4. Successfully handled contested motion practice before the Trademark Trial and Appeal Board, including obtaining numerous default judgments in opposition and cancellation proceedings.
  5. Obtained vacatur of a default judgment and reinstatement of a trademark registration that had been cancelled in a TTAB proceeding based on alleged nonuse, then negotiated a favorable resolution with the petitioner.
  6. Resolved a trademark dispute in the European Union between a medical-device manufacturer and a biotechnology company.
  7. Negotiated trademark consent and coexistence agreements across a wide range of industries, resolving conflicts concerning the registration and use of competing marks and defining the parties’ respective rights.
  8. Negotiated a favorable settlement on behalf of a leading national provider of chef-prepared meal-delivery services in a dispute involving allegations of copyright infringement.
  9. Developed litigation strategy that resulted in the settlement of a dispute involving trademark and right-of-publicity claims between a wig manufacturer and a hair model.
  10. Developed litigation strategy that resulted in the settlement of a dispute involving trademark-counterfeiting claims between an importer and a manufacturer of consumer goods from India.
  11. Developed litigation strategy that resulted in the settlement of a dispute involving trademark and false-advertising claims between two manufacturers of weighted blankets.
